Terms of Service

These Terms of Service ("Terms") govern your access to and use of OmaX AI ("OmaX", "the Service"). By using OmaX, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

OmaX is a financial analysis tool that uses automated software, including AI models and data integrations, to help users analyze companies, filings, uploaded documents, and financial data. OmaX is typically deployed and operated by a third party ("Operator") on self-hosted infrastructure.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for ensuring your use complies with applicable laws in your jurisdiction.

3. Accounts

When authentication is enabled, you must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Notify your Operator immediately if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service for unlawful purposes or to violate others' rights
• Attempt to bypass security, rate limits, or access controls
• Upload malware, unlawful content, or material you do not have rights to use
• Scrape, reverse engineer, or resell the Service without authorization
• Present OmaX output as guaranteed, audited, or professional advice without appropriate disclaimers

5. Your content

You retain ownership of files, messages, and data you submit. You grant the Operator a limited license to process your content solely to provide the Service (parsing uploads, generating responses, storing sessions). The Operator's data handling is described in the Privacy Policy.

OmaX output is informational only. See our Legal Disclaimer. The Service is not a substitute for qualified investment, legal, tax, or accounting professionals.

7. Third-party services

OmaX may call third-party APIs (SEC EDGAR, market data, web search, LLM providers). Those services have their own terms and availability. The Operator is not responsible for third-party outages or data errors.

8. Availability and changes

The Service is provided on an "as is" and "as available" basis. Features may change, be added, or removed without notice. The Operator may suspend access for maintenance, abuse, or legal compliance.

9. Limitation of liability

To the maximum extent permitted by law, OmaX contributors and the Operator shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service or reliance on its output.

10. Indemnification

You agree to indemnify and hold harmless the Operator from claims arising out of your use of the Service, your content, or your violation of these Terms.

11. Termination

The Operator may terminate or restrict your access at any time. You may stop using the Service at any time. Provisions that by nature should survive (disclaimers, liability limits, indemnity) survive termination.

12. Governing law

These Terms are governed by the laws specified by your Operator, or otherwise the laws applicable at the deployment jurisdiction. Disputes shall be resolved in the courts of that jurisdiction unless otherwise required by mandatory local law.

13. Changes to these Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes should be communicated by the Operator through the Service or other reasonable means.
